NSS Space Settlement 2008 Calendar Art Contest Terms and Conditions for Submitted Artwork

By clicking the “Submit” button on our Submit page [now closed – contest has ended] and submitting your art to the National Space Society Space Settlement Art Contest, you hereby grant the National Space Society a non-exclusive, worldwide, royalty free, perpetual license to:

  • A. Reproduce said art and associated textual description (in whole or in part) in print, electronic, and other media.
  • B. Use the art for promotional and advertising purposes.
  • C. Modify for sizing, transmission, or distribution of your submission without prior or additional consent.
  • D. Use the artists name, likeness and biographical information in connection with the art being submitted.

You also agree that:

  • A. The NSS Space Settlement Art Contest reserves the right to reject any submission without showing cause.
  • B. The National Space Society will not be held liable if one or more of the contest sponsors fails to deliver an agreed-upon prize.
  • C. NSS reserves the right to extend the contest submission deadline.

Further, you also warrant that:

  • A. The art being submitted is original art created by you and does not violate any copyrights.
  • B. The art being submitted is not subject to any third party intellectual property rights.

In addition, by submitting art in the Lunar Settlement Category and by being selected as one of the winning entries, you hereby grant to the Moon Society a non-exclusive, worldwide, royalty free, perpetual license to:

  • A. Reproduce said art and associated textual description (in whole or in part) in print, electronic, and other media.
  • B. Use the art for promotional and advertising purposes.
  • C. Modify for sizing, transmission, or distribution of your submission without prior or additional consent.
  • D. Use the artists name, likeness and biographical information in connection with the art being submitted.

This Agreement may not be amended except by written agreement between the parties.

Addendum to the Terms and Conditions of the NSS Space Settlement Art Contest.

The primary purpose of the NSS Space Settlement Art Contest, in addition to the creation of a Space Settlement Calendar, is to encourage the creation of space settlement art that could be used by NSS to promote its non-profit objective of creating a spacefaring civilization. Any use of the art by NSS would appear with proper accreditation for the creating artist. Such use could include the NSS website, the NSS magazine Ad Astra, and possible brochures and other promotional materials. We believe this use is for the benefit of the future of humanity and we hope and trust that this is a cause and use that artists would support.

However, we recognize that some artists have legitimate reasons for limiting the use of their art to the Space Settlement Calendar Art Contest only. We therefore offer the following option to artists for such limited use.

Limited Use

  • Winning images will appear in the NSS Space Settlement Art Calendar.
  • Submitted images will be displayed on the NSS web site only in association with the NSS Space Settlement Art Calendar Contest.
  • Submitted images may be used in articles in the society’s magazine and other membership publications only in connection with the Space Settlement Art Calendar Contest.
  • Submitted images may only be used in association with reporting of the Space Settlement Art Calendar Contest or publicity for or about the Space Settlement Art Calendar Contest.
  • Any further use of entries submitted to the NSS Space Settlement Art Contest would be subject to negotiation with the artist.
  • The above limitations do not apply to the Moon Society’s use of the single image that wins First Prize for Settlements on the Moon.

To invoke these “Limited Use” Terms and Conditions, the artist should email a request, no later than one week after the contest deadline, containing this or similar language: “Please limit my entry titled _____ to the purposes of the Calendar Art Contest only”. An email acknowledgement that the Limited Use terms will apply to that art work will be sent to the artist.
